LITCODER ASSESSMENT PARTICIPANT TERMS, PRIVACY AND AI USE NOTICE

These Participant Terms, Privacy and AI Use Notice ("Terms") govern participation in assessments, evaluations, benchmarking exercises and related services offered through the Litcoder platform ("Platform") by paprika Maps Pvt. Ltd., operating under the Litcoder brand ("Litcoder", "we", "us" or "our").

By selecting "I Agree", registering for or commencing an Assessment, you acknowledge that you have read and understood these Terms and agree to comply with the provisions applicable to you.

If your Assessment has been arranged by an educational institution, prospective employer or existing employer, additional terms and privacy policies of that organisation may also apply.

1. WHAT LITCODER ASSESSMENTS DO

Litcoder provides technology-enabled assessment, talent intelligence, benchmarking and development services.

These may include:

SCAV™ Talent Intelligence assessments;

Skills assessments;

Coding assessments;

engineering problem-solving and capability assessments;

AI-Augmented Development assessments;

prompt efficacy and context-engineering assessments;

cognitive, reasoning and learning-agility assessments;

code evaluation and improvement exercises;

role-readiness evaluations;

national or cohort benchmarking;

development diagnostics;

assessment reports and recommendations; and

other assessments or services notified to you before participation.

Assessments may generate scores, proficiency levels, benchmarks, percentiles, classifications, indicators, observations and recommendations ("Assessment Outputs").

PART I — YOUR PARTICIPATION

2. Eligibility and authority to participate

You confirm that:

the information provided by you is accurate;

you are the person registered to undertake the Assessment;

you will not impersonate another person;

you are legally entitled to participate in the Assessment; and

where participation has been arranged by an institution or organisation, you satisfy its eligibility requirements.

3. Assessment integrity

You agree to complete the Assessment honestly and independently except where collaboration or use of specified resources is expressly permitted.

You must not:

obtain assistance from another person;

allow another person to undertake the Assessment for you;

copy questions or answers from another participant;

communicate Assessment questions to another person;

use unauthorised websites, software, AI tools, LLMs, coding assistants or other external resources;

circumvent proctoring or security mechanisms;

manipulate browser, device or network configurations to defeat assessment controls;

attempt to access Assessment content before or after your authorised Assessment session;

copy, photograph, record, screenshot, download, publish or distribute Assessment material;

reverse engineer Litcoder's scoring algorithms or security systems;

interfere with the Platform;

introduce malicious software;

attempt unauthorised access to Litcoder systems; or

otherwise compromise the validity or integrity of the Assessment.

Where AI use is part of the Assessment, you may use AI only within the environment, tools and conditions expressly permitted by Litcoder.

Unauthorised AI use may constitute an assessment integrity violation.

4. Monitoring and proctoring

To protect assessment integrity, Litcoder may use reasonable assessment security and proctoring controls disclosed for the particular Assessment.

Depending upon the Assessment, these may include collection or processing of:

IP address;

browser and device information;

operating-system information;

timestamps;

Assessment navigation and activity;

responses and code submissions;

window/tab switching events;

copy/paste events;

Assessment interaction logs;

permitted AI interaction logs;

suspicious activity indicators; and

where expressly disclosed and permitted, camera, microphone or image information.

Litcoder will not use intrusive monitoring mechanisms beyond those reasonably required for the Assessment and disclosed to participants.

PART II — PERSONAL DATA AND PRIVACY

5. Information that may be processed

Depending on the Assessment and the organisation arranging it, personal data processed may include:

Identity and registration information

Name, email address, telephone number, candidate or employee identifier, institution, employer, degree, course, graduation year and other registration information.

Assessment information

Responses, code, prompts, AI interactions, solutions, scores, time taken, attempts, question-level performance and other Assessment activity.

Technical information

IP address, device characteristics, browser information, session logs, security logs and authentication information.

Proctoring information

Where applicable and expressly disclosed, images, video, audio or other information required to verify identity or Assessment integrity.

Derived information

Litcoder may derive Assessment Outputs including:

SCAV™ scores, dimension scores, proficiency classifications, percentiles, benchmarks, role-readiness indicators, performance patterns and other talent intelligence signals.

6. Purposes of processing

Personal data may be processed only for purposes relevant to the applicable Assessment, including:

registration;

identity verification;

administering Assessments;

maintaining Assessment integrity;

preventing fraud or impersonation;

scoring Assessment responses;

generating Assessment Outputs;

preparing reports;

benchmarking performance;

providing results to authorised organisations;

enabling talent-development recommendations;

maintaining Platform security;

troubleshooting;

complying with applicable laws; and

other purposes specifically disclosed to you.

Personal data will not knowingly be used for unrelated purposes without an appropriate lawful basis and, where required, appropriate notice or consent.

7. ROLE OF LITCODER AND THE SPONSORING ORGANISATION

Organisation-sponsored Assessments

Where an employer, prospective employer or educational institution commissions Litcoder to conduct an Assessment and determines why the Assessment is being conducted and how its results will be used, that organisation will generally act as the relevant Data Fiduciary and Litcoder will generally process personal data on its behalf as a Data Processor.

Litcoder will process such personal data in accordance with:

the agreement with the organisation;

documented processing requirements;

applicable law; and

these Terms.

Litcoder-directed services

Where you register directly with Litcoder or Litcoder independently determines the purpose for which particular personal data is processed — for example, operating a Litcoder account, maintaining a Litcoder benchmark or talent profile, or enabling participation in a Litcoder-operated talent ecosystem — Litcoder may act as a Data Fiduciary for those specific processing activities.

8. DATA SHARING

Assessment information will not be publicly disclosed by Litcoder.

It may be disclosed to:

the institution sponsoring your Assessment;

a prospective employer sponsoring your Assessment;

your employer where the Assessment is employer-sponsored;

authorised Litcoder personnel;

technology/service providers supporting Litcoder;

cloud infrastructure providers;

proctoring providers;

security and fraud-prevention providers;

analytics or AI technology providers where required to provide the service; and

government, regulatory or law-enforcement authorities where disclosure is legally required.

Service providers will be subject to appropriate confidentiality, data-processing and security obligations.

9. DATA MINIMISATION

Litcoder will seek to process only personal data reasonably required to provide the Assessment and related services.

Participants should not enter unnecessary personal, confidential, proprietary or sensitive information into Assessment answers, prompts, code or AI interactions.

In particular, participants must not intentionally submit:

passwords;

authentication credentials;

financial information;

government identification numbers unless expressly requested;

confidential employer information;

proprietary source code;

third-party personal data; or

information that they are not authorised to disclose.

10. RETENTION AND DELETION

Personal data will be retained only for as long as reasonably necessary for the purposes for which it was processed, contractual requirements, assessment validity, dispute resolution, security requirements and applicable law.

For enterprise-sponsored Assessments, retention may also be determined by Litcoder's agreement with the sponsoring organisation.

Upon expiry of the applicable retention period, Litcoder will delete, anonymise or otherwise render personal data non-identifiable, subject to lawful retention requirements.

PART III — SECURITY

11. Litcoder's security responsibilities

Litcoder will maintain reasonable technical and organisational safeguards designed to protect personal data against:

unauthorised access;

unauthorised disclosure;

alteration;

loss;

misuse; and

destruction.

These controls may include, where appropriate:

encryption in transit and at rest, access controls, authentication, role-based permissions, logging, vulnerability management, backup and recovery, secure development practices, employee confidentiality controls, vendor security controls and incident-response procedures.

12. No absolute security guarantee

No internet-based system can be guaranteed to be completely secure.

Litcoder therefore does not warrant that unauthorised third parties will never defeat security controls, but will implement reasonable safeguards appropriate to the nature of the information and service.

Participants are responsible for:

protecting their login credentials;

securing their device;

using trusted networks where reasonably possible;

maintaining current operating systems and browsers;

not sharing Assessment links or credentials; and

immediately reporting suspected compromise.

PART IV — AI USE AND AUTOMATED ASSESSMENT

13. Use of artificial intelligence

Certain Litcoder Assessments and Assessment Outputs may use artificial intelligence, machine learning, statistical models, algorithms, rules-based systems, large language models or combinations of these technologies ("AI Systems").

AI Systems may assist Litcoder in:

evaluating responses;

analysing code;

evaluating prompts;

identifying patterns;

classifying performance;

generating explanations;

generating developmental recommendations;

generating Assessment summaries; and

identifying potential Assessment integrity anomalies.

14. AI OUTPUTS ARE DECISION-SUPPORT SIGNALS

Assessment Outputs, including AI-generated or AI-assisted outputs, are intended to provide decision-support information and talent intelligence signals.

They are not intended to constitute an infallible or complete determination of an individual's capability, employability, performance, potential or suitability.

AI and algorithmic systems can produce errors, incomplete interpretations, false positives, false negatives or outcomes affected by limitations in available evidence.

Accordingly, Litcoder Assessment Outputs should be interpreted as one source of evidence and should not ordinarily be used as the sole basis for a consequential employment, recruitment, promotion, termination, compensation or similar decision.

15. HUMAN JUDGMENT

Employers, educational institutions and other organisations receiving Litcoder Assessment Outputs are responsible for determining how those outputs are used.

Litcoder recommends that organisations combine Assessment Outputs with other relevant evidence, which may include:

interviews;

qualifications;

experience;

work samples;

role requirements;

behavioural evidence;

organisational context; and

human judgment.

Litcoder does not make the ultimate hiring, rejection, promotion, deployment, termination or other employment decision unless expressly agreed otherwise.

16. NO GUARANTEE OF EMPLOYMENT OR PERFORMANCE

A Litcoder score, proficiency level, percentile, ranking, badge or certification does not guarantee:

employment;

interview selection;

shortlisting;

promotion;

salary;

internship;

placement;

admission;

future job performance; or

career success.

Similarly, a lower score does not establish that an individual is incapable of successfully performing a role.

Assessment results reflect performance against defined evidence and methodology at a particular point in time.

PART V — INTELLECTUAL PROPERTY

17. Litcoder intellectual property

All Assessment questions, scoring methodologies, frameworks, reports, algorithms, software, interfaces, graphics, documentation, trademarks and other Litcoder materials are owned by or licensed to Litcoder.

This includes the SCAV™ framework and associated assessment architecture.

Participation does not grant you ownership of or a licence to reproduce Assessment materials.

18. Candidate submissions

You grant Litcoder the limited rights necessary to process your submissions for:

administering the Assessment;

scoring;

generating reports;

maintaining Assessment integrity;

resolving disputes;

providing contracted services; and

improving the reliability and validity of Litcoder's assessment methodology where legally permitted.

anonymised/de-identified assessment evidence for model and assessment improvement wherever possible.

PART VI — PLATFORM AVAILABILITY

19. Technical failures

Litcoder will make reasonable efforts to provide reliable Assessment services.

However, Assessment availability may be affected by circumstances including:

internet failure;

participant device failure;

browser incompatibility;

electricity failure;

third-party infrastructure;

cloud outages;

telecommunications failures;

cyber incidents; or

circumstances beyond Litcoder's reasonable control.

Litcoder does not guarantee uninterrupted Platform availability.

Where a material Litcoder-controlled technical failure affects an Assessment, Litcoder may, where appropriate:

restore the session;

permit re-attempt;

reschedule the Assessment;

invalidate the affected Assessment; or

take another reasonable corrective action.

PART VII — INVALIDATION AND MISCONDUCT

20. Assessment invalidation

Litcoder may flag, suspend or invalidate an Assessment where there is reasonable evidence of:

impersonation;

cheating;

unauthorised AI use;

prohibited collaboration;

unauthorised copying;

manipulation of Assessment systems;

interference with proctoring;

suspicious technical behaviour; or

material breach of these Terms.

Where appropriate, Litcoder may communicate the existence of an integrity concern to the organisation sponsoring the Assessment.

PART VIII — PARTICIPANT RIGHTS

21. Personal-data requests

Depending upon the processing relationship and applicable law, participants may have rights relating to:

access to information about processing;

correction of inaccurate personal data;

updating personal data;

erasure;

withdrawal of consent where processing is based on consent;

grievance redressal; and

nomination or other rights available under applicable law.

PART IX — SCHEDULES (AS APPLICABLE TO YOU)

SCHEDULE A — STUDENTS / INDEPENDENT PARTICIPANTS

Where you participate directly in a Litcoder Assessment, including LNBE or another benchmarking programme:

Your results may be used to:

calculate your SCAV™ score;

benchmark you against relevant participant populations;

generate percentile or proficiency information;

provide developmental feedback;

create a Litcoder talent profile where applicable; and

make you discoverable to prospective employers only where this has been disclosed and appropriately enabled/authorised.

SCHEDULE B — ENTERPRISE RECRUITMENT CANDIDATES

Your Assessment has been requested by an Organization as part of a recruitment or selection process. The Employer determines the recruitment purpose for which the Assessment is conducted.

Litcoder provides the Assessment and related talent intelligence services to the Employer. Your Assessment Outputs may therefore be provided to the Employer.

Litcoder does not control:

the Employer's hiring criteria;

the relative weight assigned to your Assessment;

interview decisions;

hiring or rejection decisions;

compensation decisions; or

subsequent use of information independently retained by the Employer.

Questions concerning the Employer's recruitment decision should be addressed to the Employer.

SCHEDULE C — ENTERPRISE EMPLOYEES

Your employer has requested your participation for one or more organisational purposes that should be disclosed to you, which may include:

capability assessment;

training needs analysis;

development planning;

workforce capability mapping;

internal mobility;

deployment;

role readiness; or

talent development.

Assessment Outputs may be provided to your employer.

Litcoder does not determine whether your Assessment results will affect your role, promotion, compensation, deployment, performance rating or continued employment. Such decisions are made by your employer in accordance with its policies and applicable law.

PART X — LIMITATION OF LITCODER'S ROLE

22. Litcoder does not

Unless expressly contracted otherwise, Litcoder does not:

make hiring decisions;

terminate employees;

decide promotions;

determine compensation;

verify every claim made by participants;

guarantee employment outcomes;

guarantee future job performance;

guarantee that an AI-generated conclusion is error-free;

control an organisation's independent use of Assessment Outputs; or

provide legal, employment or career guarantees.

Litcoder's responsibility is to administer assessments and generate evidence-based Assessment Outputs using its defined methodologies.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Litcoder will not be liable for indirect, incidental, special or consequential losses arising from:

employment decisions made by third parties;

institutional decisions;

participant misuse;

unauthorised disclosure by a participant;

inaccurate information supplied by participants or sponsoring organisations;

events outside Litcoder's reasonable control; or

decisions made by third parties relying on Assessment Outputs contrary to their intended use.

24. CHANGES TO THE ASSESSMENT

Litcoder may periodically modify:

Assessment content;

question banks;

scoring methodology;

benchmarks;

algorithms;

AI systems;

proficiency classifications; and

reporting formats,

to improve reliability, validity, security or relevance.

Scores from different versions or periods may therefore not always be directly comparable unless Litcoder expressly states otherwise.

25. GOVERNING LAW

These Terms will be governed by the laws of India.

Subject to applicable law and any mandatory rights available to participants, disputes concerning Litcoder's services will be subject to the jurisdiction of the courts at Bengaluru, Karnataka, India.
